In the first quarter of 2013 surveyors across the UK reported increased workloads that bring the building industry to a level not seen since the end of 2007. The rise in the private housing construction suggested that some of the government initiatives were beginning to work and revitalise the construction sector. With the rise in workloads many chartered surveyors anticipate a rise in employment levels over the coming year. However despite of noticeable rise in London, the South East and the Midlands , Northern Ireland and Scotland still continue to see falling workloads.

HMRC has capped penalties for late CIS returns

Since 1 October HMRC has capped penalties for late returns of payment information to contractors under the Construction Industry Scheme at £3,000. Before then penalties for failing to register with the CIS scheme were £100 each month and could amount to tens of thousands of pounds. Some building contractors have claimed that the taxman is prepared to waive some of the heftier fines under the old penalty system.

HMRC is taking steps to reduce CIS repayments delays

Following a number of concerns expressed by by Construction Industry contractors regarding delays in issuing CIS repayments, HMRC are taking urgent steps to rectify the situation so that they can repay contractors as quickly as possible. HMRC are redeploying up to 60 staff to help to manage this work. Current plans indicate that by the end of August the backlog of CIS scheme repayments will be reduced to 15 days work on hand.

P35 Employer Annual Return for Contractors and Subcontractors

Form P35 for the year 2010-2011 is due for completion on or before 19 May 2011. If the return is submitted late you may receive a penalty. Although it is not a legal requirement to submit Construction Industry Scheme (CIS) monthly returns online, in all but a very few exceptional circumstances it is mandatory to file the form P35 electronically. Failure to do so may also incur a penalty.

HMRC warns on CIS late-filing

HMRC has issued a reminder that penalties for late or non-filing of monthly Construction Industry Scheme (CIS) returns by contractors are changing from November 2011.

Under CIS, contractors are obliged to file a monthly return and account for any sums deducted from subcontractors.

The new penalty regime comes out of the Finance Act 2009. The first CIS return affected by the changes will be for the month ending on 5 November 2011.

From November 2011, the following penalties will apply to returns that are not filed, or are filed late:
